TLDR – if working in Europe without a work visa, you’ll probably get away with it for short trips, but whatever you do, DO NOT BREAK the 90/180 Day Rule.

Ok, so, you go somewhere to work, without the right papers, and get caught, mostly you get deported and banned from going back.

Some places might imprison you. Don’t go to those places.

And, if that’s somewhere you don’t care about, fine. The risk is worth it. Who wants to go to America more than once anyway?

Europe

Is different. Is next door. Is somewhere you probably want to visit lots. And everyone is confused about the rules.

So, here are the rules, as I understand them.

Basic Rule : Don’t get yourself banned from Europe by accident!

Schengen Zone countries we can travel to as Brits, on the 90/180 day rule.

90/180 Day Rule

You can be in Schengen Zone for a maximum of 90 days out of 180.

But this is for personal travel – holidays, visiting potential business clients etc. It doesn’t allow for working. Working as in being paid to….. I believe you’re fine if you are going as a Producer and so spending money. But if taking kit, you’ll need a Carnet.

It’s on a rolling basis, so if you are making frequent visits of a few weeks at a time, keep a proper count!

Note that is doesn’t matter if you are in France, then Spain then…the 90 days is related to anywhere in Schengen.

Logging your dates is automated – you are logged at EVERY passport control. (Tip – when leaving a country, always demand an exit stamp. If there is a cock up, this will show you left on the given date).

Overstaying

They really don’t like people who over stay, and are not interested in any reasons or excuses. https://www.schengenvisainfo.com/consequences-of-overstaying-in-schengen-area/ for example, if you have an accident and can’t leave (in hospital), you are expected to apply for an extension.

You can get caught as you leave, OR when you next try to enter. You can be fined or banned when that happens.

Fines : can be large. IIRC Greece will charge you 500 Euros to 1500 Euros depending how long you overstayed. Each country sets their own rules re this.

Bans : you probably won’t get banned from Schengen on a first offence unless you have been caught working or doing illegal stuff. But if banned , 3 years is normal, and it can be longer.

Getting banned from Schengen basically means you can’t go to Europe, so, from now on your holidays are going to be in UK, or long distance.

If you like visiting Europe, be very careful about overstaying, and don’t get caught working illegally.

Work Visas inc in Schengen

Each country makes it’s own rules about work visas.

Generally you’ll need a work visa if you want to do paid work (employed or self employed), but each country makes it’s own rules and enforcement will vary.

For example Perpetual Travelers will talk about travelling under Tourist Visa rules, and working in the country they visit, BUT they tend to be doing online work, often for clients “back home” and are very much under the radar, and NOT trying to become locally employed. They are also very careful to only spend limited time in each country.

IMO, travelling and doing collabs, (so no one is paying you), fine. Camming as you go, fine.

Going places and HIRING local cast for porn? You’re spending money, knock yourself out. But read up on getting your kit in and out of the country – carnets etc – unless you are travelling light enough to look like a tourist.

Porn as a hired performer? Well, for starters, it’s “Actor being hired for a few days work” 🙂 But some countries are fine with that. And even if you’re not supposed to, the risk is low. You will be logged into the country as a tourist, and then out again a week or two later. Nothing to see here.

Escorting? Even if legal in the country, it’s work, so illegal without the right papers (e.g. for your OTHER job there). BUT, if you stay low profile, is anyone going to find out?

Other – non industry – Job – asked to come over and do whatever for a 3 or more months. You def want that to be on a proper work visa, because you WILL be breaching 90/180 Day Rule and when they check into it, they’ll conclude you were working and then you’re looking at being banned for at least 3 years.

Is a local Work Visa breach ALSO a 90/180 breach?

Basically, does getting chucked out of Spain for illegal escorting get you barred from the WHOLE Schengen area?
